Terms of use
These terms are for anyone using Kuku 防災助手 ( “the App”). Read them before installing, opening, or using the App. They explain your license, purchases, and rights and responsibilities.
The App is provided by YU MAO SHIH (“we” or “us”). It includes an iOS or Android app and a free web version. By installing, opening, or using the App, you agree to these terms. If you do not agree, do not use the App.
1. License to use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control. This license is for personal, non-commercial use. You may not:
- Copy, modify, distribute, rent, or resell the App or its data packages.
- Disassemble, decompile, or reverse-engineer the App, except where expressly permitted by law.
- Remove copyright notices, license notices, or data attributions from the App.
- Use automated methods to extract large amounts of App content for other purposes.
Versions obtained through Apple App Store or Google Play are also subject to that store’s terms of service.
These restrictions do not limit rights granted by the original licenses for open data and open-source components.
2. In-app purchases
- Paid features are a one-time in-app purchase. They are not a subscription and do not renew automatically.
- Apple App Store or Google Play processes transactions and issues receipts. The price shown by the store applies and may vary by region and tax rate.
- Refund eligibility and outcomes depend on applicable law and store policies. You can apply to Apple or Google Play. Contact us if you need help. A request does not guarantee approval.
- Purchases are linked to a store account and can be restored on supported devices using the same store and account. iOS and Android purchases do not automatically carry over. Restore reinstates Plus access; it does not sync supplies or medical cards or include Family Sharing.
3. Exception to the seven-day right of withdrawal
The App’s paid features are digital content supplied without a physical medium. They are provided immediately after you agree. Under Article 2, subparagraph 5 of 《通訊交易解除權合理例外情事適用準則》 (Taiwan’s rules on exceptions to cancellation rights for distance purchases), digital content supplied with prior consumer consent is exempt from the unconditional seven-day right of withdrawal in Article 19, paragraph 1 of 《消費者保護法》 (the Consumer Protection Act).
Before you complete a purchase, we will show the following statement and ask you to confirm it:
This is digital content supplied without a physical medium. It will be available immediately after purchase. I agree to receive it immediately and understand that, under Article 2, subparagraph 5 of 《通訊交易解除權合理例外情事適用準則》 (Taiwan’s rules on exceptions to cancellation rights for distance purchases), this purchase is not subject to the seven-day right of withdrawal under Article 19, paragraph 1 of 《消費者保護法》 (the Consumer Protection Act).
You enter the store payment process only after confirming this statement.
4. Data and accuracy
Shelter data is compiled from datasets published by county and city governments or police departments on the government open data platform. See “Data sources and licenses”. We combine and clean this data using software. We do not guarantee its accuracy, completeness, or timeliness. Shelters may have changed, closed, or become inaccessible. In an emergency, follow government alerts and instructions at the site. See “Disclaimer”.
5. No warranties
To the fullest extent permitted by law, the App is provided “as is” and “as available”. We make no express or implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
6. Limitation of liability
The App’s data and tools have limitations. Use judgment based on conditions at the site. Liability arising from use of the App is determined under applicable law. These terms do not exclude or limit liability that cannot legally be excluded, or affect consumers’ statutory rights.
7. Intellectual property
The App’s code, interface design, and trademarks belong to us or our licensors. Shelter data, administrative boundaries, and base maps are provided under their original licenses. See “Data sources and licenses”.
8. Termination
If you breach these terms, we may terminate or suspend your license to use the App at any time. You may end these terms at any time by deleting the App. Termination does not affect completed store transactions.
9. Changes to the terms
We may revise these terms from time to time. We will update the “Last updated” date and announce revisions in a new App version. Continuing to use the App after changes take effect means you agree to the revised terms.
10. Governing law and jurisdiction
These terms are governed by the laws of the Republic of China (Taiwan). Jurisdiction for disputes is determined under applicable law, without affecting consumers’ statutory jurisdictional rights.
